TERMS OF USE

TERMS OF USE – ELECTRONIC RECEIPT OF RED ALERTS, EMERGENCY INFORMATION ADVISORIES AND TORNADO WARNINGS

1. The Office of the Fire Marshal and Emergency Management allows you to subscribe to its Red Alerts, Emergency Information Advisories and Tornado Warnings services (the “Warnings”) as part of the Government of Ontario’s emergency response public warning system. In order to receive Warnings electronically, please read the following terms of use, which may be amended from time to time without notice to you (“Terms of Use”). By clicking on the “Accept” button below, you accept and have agreed to be bound by the Terms of Use.

2. The Office of the Fire Marshal and Emergency Management provides Warnings, in accordance with its mandate, 24 hours a day, 7 days a week. Warnings can be received by e-mail, mobile device text messages and/or desktop notifications. Warnings are transmitted in English and French.

3. In order to subscribe to Warnings, you must have access to the appropriate technology and equipment, and you may be charged service fees by your technology provider. The Office of the Fire Marshal and Emergency Management is not responsible for any costs and expenses incurred by subscribers receiving Warnings.

4. The Office of the Fire Marshal and Emergency Management makes every effort to ensure that the content of the Warnings is accurate and up to date. However, The Office of the Fire Marshal and Emergency Management does not guarantee, or make any warranty express or implied that (i) the Warnings are current, accurate, complete or reliable; or, that (ii) the Warnings will be available without interruption, error or omission. Her Majesty the Queen in Right of Ontario, including its agents, employees, volunteers and contractors are not responsible or liable for any damage or loss, however caused, which results directly or indirectly from use (including failure to use) or reliance on the Warnings, either by a subscriber or by anyone else.

5. The Office of the Fire Marshal and Emergency Management collects personal information from subscribers in order to provide subscribers with Warnings. This personal information is protected under the Freedom of Information and Protection of Privacy Act (FOIPPA). Your acceptance of these Terms of Use constitutes your consent to such information being collected and used. 6. The Warnings may be linked, or may contain links, to Web sites that are not operated by The Office of the Fire Marshal and Emergency Management. Linked Web sites may not be available in French. The Office of the Fire Marshal and Emergency Management neither endorses nor assumes any responsibility for the content of linked Web sites. Both your use of a linked Web site, and your right to use or reproduce information or materials from a linked Web site, are subject to the terms of use governing that particular Web site.

7. You must be age 16 or over to receive Warnings. If you are under the age of 16, you may still receive Warnings if you have the permission of a parent or legal guardian.

8. You acknowledge that you do not have and will not obtain any intellectual property right in or to any information contained in the Warnings. The Warnings may not be reproduced in whole or in part except with the written permission of The Office of the Fire Marshal and Emergency Management.
